Rights and Benefits Tribunals
Some tribunals make decisions about your rights and benefits.
For example, the Immigration and Refugee Board makes decisions about who can live in Canada. That board considers the law and makes a decision about the applicant’s right to stay in Canada. Other tribunals make decisions about the benefits that a person is entitled to receive. For example, the Employment and Assistance Appeal Tribunal would make a decision about whether you are entitled to income assistance.
Federal
CPP and OAS: Office of the Commissioner CPP/OAS Review Tribunals
Hears appeals from decisions regarding the Canada Pension Plan, Old Age Security, Social Security Agreements, and claims that the legislation is discriminatory under the Charter of Rights and Freedoms.
Provincial
Mental disorders (criminal cases): BC Review Board
Reviews decisions about people who have been charged with offences under the Criminal Code in respect of whom verdicts of “not criminally responsible on account of mental disorder or unfit to stand trial on account of mental disorder”, have been rendered.
Mental health: Mental Health Review Board
Conducts hearings under the BC Mental Health Act.
